I am working in an IT company. I haven't gone to the office for 2 months because of personal reasons. My HR treated this as unauthorized absence and applied a leave ending report form, which was approved by HR and the system. Now, what are the consequences of this? Is there any deduction in salary? If there is a deduction, how much will it be?

The absence is indeed unauthorized.

Did you try to contact your office about the reason for the absence in the two months?

It is certain that deductions will be there in your pay if any.

The company may offset some available leave against your absence if genuine and convincing reasons are adduced.

The relationship between employer and employee is two-way. An employee cannot absent himself without notice for two months and expect the company to tolerate this.

How is someone not in that company expected to know what a leave-ending record is and what it means? However, if the leave is unauthorized, how do you expect them to mark it as anything else?

After remaining absent for about 2 months without prior permission or sanction of leave, how can you expect your salary? The Management will initiate action as per the appointment letter or rules and regulations applicable to your category. The Management has sent you the call letter after 7 days of long absence. They should have sent you the Show Cause Notice calling for your explanation for the remaining absence during that period. Be ready with your explanation and proper documents to face the disciplinary actions.

If HR is applying 'leave' to cover the absence and that 'leave' is from your vacation leave or any other paid leaves, there should be no reduction in your salary. I am not certain what is included in your terms and conditions of employment, but usually, there should be some consideration for emergencies as well.

However, if there is insufficient leave available to cover the absence, you may only be paid for the amount of leave you had accumulated.

If HR asked one to work in the very lowest post against the designation of appointment, deliberately, without giving reasons (even though the employee has a clean record), what sort of action may be initiated on the employee's absence of 4 months?

You should think in this way - you are the BOSS, and your employee has taken uninformed leaves for almost 2 months. What action will you take? Will you pay him, take necessary action against his unprofessional behavior, or terminate him based on uninformed long absenteeism?

It's good that the company has not taken any action against your long uninformed absenteeism, and you should thank them instead of asking for a salary.

Shri Ghale has been posting this query repeatedly in the forum. I would advise him to seek legal advice to sort out his problem with his employer. Apparently, the organization has dealt with his case incorrectly, and he can get a legal remedy to his issues.
