Forced Resignation and Unsettled Dues: How Should I Navigate This Situation?

Dear Sir, I was working in an organization for the past 8 years, and they started deducting for the past 6 1/2 months. Recently, when I was on an official tour (I was working in marketing), there were issues with my increment. I asked my immediate superiors, and they wanted me to speak to my Managing Director. I called my MD over the phone, and he instructed me to come to the Head office the following week. However, to my surprise, when I reached my station (my branch office), all the emails/folders in my (official) system were deleted. Despite my inquiries, there was no response from my colleagues or superiors.

The next day, my superior informed me that it was a management decision regarding the increment. Anyone questioning it would be asked to resign. I expressed my willingness to accept the decision and continue working, but my superior insisted that I submit my resignation. I tried to contact my Managing Director from my official mobile, but the service was suddenly stopped. I then called my MD from my personal mobile, and he also requested my resignation. Consequently, I submitted my resignation, which was duly signed and stamped by a colleague at my branch office. I requested my superior, the Managing Director, to expedite my settlement. It has been almost a week, and I have not received any communication from them. I am seeking your advice on how to proceed further.

As per my appointment order, the relieving period is 90 days, and I am eligible for leave salary, and any applicable bonuses.

Please advise on the next steps.

Seeking Advice on Employment Settlement

I was working in a private limited company in Tamil Nadu, India, as a Senior Manager in the Sales department. Last week, while on an official tour, our company announced an increment for all workers/staff. I was not satisfied with the increment, so I spoke over the phone to my immediate superior, who asked me to speak to his superior in charge of the sales department. When I spoke to him, he directed me to speak to the Managing Director. The MD requested that I come to the head office the following week, as I was working in the branch office. I informed both my superiors and continued working while on the official tour.

To my surprise, when I returned to my home station after the business tour on Friday, 10.07.2015, all the details, emails, offers, and other folders on my desktop were completely deleted. When I asked my colleague, he replied that he didn't know anything (there are only two staff in our office - myself and my colleague). I immediately reported the issue to my superiors and the MD via email from my personal ID.

On Saturday, 11.07.2015, in the afternoon, I received a call from my immediate superior, who informed me that it was the management's decision to give the increment, and anyone asking for more would be asked to resign. Even though I said, "Okay, sir, I shall accept and work with this itself," I was forced to submit my resignation letter. I then called my Managing Director from my office mobile, but the services were disconnected. I spoke to my MD over the phone, and he also told me to resign, saying that I would be relieved immediately. I asked him about my settlement, as my notice period is three months. He replied that he was not in the office and would check and reply on Monday, 13.07.2015. I then submitted my resignation and obtained a copy duly sealed and signed by my colleague after handing over all the documents.

I sent an email to my MD on 14.07.2015, but to date, I have not received any reply.

As per my appointment order, I am supposed to receive gratuity (since I worked for eight years), three months' notice period salary, bonus, and leave salary.

Can anyone help me on how to proceed further in obtaining the same?

When you have been so abruptly terminated and treated so ruthlessly, there is no other way than legal proceedings to get your dues released. You could probably send them a written request asking for your dues as per the appointment order. You must specify that you have been forcibly made to resign and ask for your dues. As a matter of fact, you should take them to court for illegal termination. Asking for an increment is not an offense.
