Dear sir, kindly let me know that where to complain against my company because the no. of employee is more than 20 and they have not registered their company in esic, while i have told him several times to register it in esic...kindly guide me.

The first point is that ES I C is not required when the company has more than 20 employees, but when it has more than 20 employees with salary of less than 15,000 Per month.
As you mean that they are covered but not registered, you can complain to the local office of ESIC.
I hope you realise, that the moment the inspector step in and take action, you will lose your job. Whether or not you have actually complaint, your employer will assume that it was you who has gone and given the information and will take action against you

to be more exact the condition of ESIC is there must be minimum 10 employees whose salary would be upto 15 k .

1. Sir, the remarks of Mr.Saswata Banerjee as "the first point is that ES I C is not required when the company has more than 20 employees, but when it has more than 20 employees with salary of less than 15,000 Per month." appears to be not correct in view of legal position as prevalent at present. In order to attract the provisions of ESI Act, 1948 the requirements are (a) the unit ( i.e. factory ) must be employing 10 or more persons and (b) the said unit (a factory) must be situated in such area which is an implemented area under section 1(3) of said Act. Even if one persons out of 10 such persons is getting wages upto Rs.15000/-, even then the said unit will be coverable and compliance is required to be made under said Act. Even in Mumbai/Maharashtra area, where so far as I know the appropriate Govt. has not so far reduced the coverage to 10 to 19 persons in respect of selected establishments under section 1(5), the units under category of "factory" are coverable immediately the same will employ 10 or more persons under section 1(3) of said Act. I hope Mr. Banerjee may kindly see the amendment in the said Act carried out in the year 2010 and may kindly also like to guide me if I am wrong.

2. Similarly, I feel that the remarks of Sh. Gautam Dwivedi as above appears to be not correct so far as legal position is concerned in view of my submission as above.

3. Further, Local Office of ESIC has nothing to do with the coverage or uncoverage of units under said Act. The Local Office, or Branch Offices of ESIC are concerned with the disbursement of cash benefits to the insured persons and their dependants and for registration procedure of insured persons. If you have any issue of such kind, you can take up the matter with either the Regional Director/Joint Director (Incharge) of the Regional/Sub Office or Social Security Officer of ESIC to the jurisdiction of which, the concerned unit is situated.
