I have resigned from a company from the post of consultant where I have been serving for 3-4 years. My job involved visiting clients 2-3 times per week for consultations. However, for the past 6 months, my pay was withheld citing a shortage of funds. I continued in the hope that the issue would be resolved, but I began to suspect foul play, leading to my decision to resign.

Despite resigning, my final settlement has not been processed, and I am in urgent need to contact the CEO. Unfortunately, he has been avoiding communication with me. The accounting department provides vague responses, further complicating the situation.

Please guide me on how to proceed.

Send the company a registered letter of acknowledgment due. Detail the dues and attempts made by you to contact and the response thereof. If after this, there is no closure of payments and other dues, then consider making it a legal matter. How much is the amount due to you? Preserve all correspondence and appointment letters safely as they may be required in case of a legal battle. Do not let the company get away with non-payment of dues.

Do you receive an agreement or appointment letter from the company at the time of appointment? If yes, you can file a case in court or claim your final settlement based on the terms and conditions outlined in the appointment letter. It is advisable to email the CEO of the company directly to explain your issue in detail.

1. What are the payment terms as per the agreement?
2. How are the payments being made—cash/cheque/NEFT, etc.?

4. Is the "shortage of funds" true, or were there any issues between you and the management?
