Facing Unprofessional Behavior After Resignation: How Should I Handle This?

Hi team, please assist me ASAP. I am working at EXL Service and I joined EXL on 31st October 2014. Due to some personal reasons, I resigned from the company on 16th June 2015, and my last day of work is 30th July 2015. As per company policy, I am required to serve a 45-day notice period. However, after my resignation, my manager has been very unprofessional towards me. He has been aggressive on the floor and even asked me to return my resignation, but I was not willing to do so. He was reluctant to accept my resignation. On 18th June 2015, I sent an email to HR requesting acceptance.

For the past 2-3 days, they have been creating different kinds of problems. Yesterday, my HR tried to get my signature on a PIP letter from a backdate. When I refused to sign, she threatened to terminate my employment. Please advise...

After the expiry of your notice period, you will be deemed to have been relieved, whether your manager accepts your resignation or not. Furthermore, please send a letter to your employer stating that you are being forced to resign by Sh.... On ...., he threatened you by saying....

They are not forcing me to resign, as I have already resigned. However, they are forcefully putting me on a PIP and pressuring me to sign the papers, indicating they will terminate me before my notice period completes. Please advise if they can terminate me unethically after my resignation.

Before resigning, they didn't have any problems with me regarding my performance. After resigning, they are creating a scene for my previous performance without any documentary proof. They are going against their policy to create a problem for me.

Handling Backdated Documents and Termination Issues

Do not sign any letter with a backdate. If you want, you can send a notice to them stating that, since you are governed by the Punjab Shops and Establishment Act, you are required to give only a week's notice or pay one week in lieu. Since you have already covered that period, you are deemed to have been relieved as of today. Even if they terminate you, that is null and void.

Otherwise, if you want to wait for the expiry of 45 days, then even if the employer terminates you without reasonable cause, that will be illegal, and you will be entitled to up to 2 months' wages as per the Act. If they terminate you without one month's notice, it will be illegal.

Do you have a receiving copy of your submitted resignation? If not, you will face problems. If you have it after the expiry of your notice period, you will be deemed to have been relieved, whether your manager accepts your resignation.

If I may ask, what's PIP? Irrespective of what PIP is, as Sushil mentioned, NEVER sign anything with a backdate. You mentioned you mailed your resignation—was it from your official mail ID or personal ID? If from the official mail ID, please forward the mail to your personal mail ID.

Looking back, I think it would have been more appropriate if you had discussed your intention to resign, and the reasons thereof, with your manager before you resigned. Saying 'personal reasons' on forums like CiteHR is one thing, and saying the same thing to your boss is quite another. Presuming you said the same 'personal reasons' to your manager, no wonder he got the impression that you are up to something and the actual reason is not personal. However, this does not mean that whatever he did is right. It only means you could have handled it better.

Do you have any agreement/bond that you signed when you joined?

Have you received any acknowledgment for your resignation letter from your immediate supervisor? When you sent an email to HR, did you receive any reply from them via email? In the absence of acknowledgment, it will be difficult to prove the submission of the resignation letter.
