Navigating Employee Transfer and Notice Period Issues: Insights and Advice

Please let me know. I have been asked to transfer, due to which I have put in my resignation. However, my manager informed me that even if I resign, I will still need to serve my notice period at the assigned location where I am being transferred. I do not wish to go there. I have officially resigned before receiving my formal transfer letter. As I am not willing to relocate, and my manager is not considering my notice period at my current location, what should I do?

Are there any rules regarding employee transfers during the notice period? If I am unwilling to move and the organization insists on the transfer, what steps should I take? The only option I see is to leave without notice, which I would prefer not to do. Please provide some advice.

If conditions of service provide for transferring to any other place in the country, an employee can be transferred by the employer.

Regarding resignation, under Section 66 of the Bombay Shops and Establishment Act, an employer has to give a month's notice or pay wages in lieu thereof when terminating a permanent employee. On the same note, an employee can also give one month's wages in lieu of the notice period when resigning. Tender the said amount and request for relieving. Failing this, approach the inspector under the said Act to obtain your relieving certificate.
