Waiting for Relieving and Experience Letters: How Can I Speed Up the Process?

Hello Sir, I had been working in a Pvt. Ltd. company in Bangalore for the past 5.8 years. Now, I've received another opportunity and resigned from my position after serving a one-month notice period, with the remaining two months' notice to be deducted from my Full and Final (F&F) settlement. It has been four days since my last working day, but I have not yet received my relieving letter, experience letter, and F&F settlement calculations. I was informed that these documents need approval and processing from the head office in Noida. This delay is preventing me from joining my new firm as I am required to provide the relieving letter and experience letter. Could you please assist me in this matter and advise me on what steps I can take?

You can produce the resignation letter to the new employer and convey that the relieving letter is under process. If that is not forthcoming despite requests, you must approach the inspector under the Shops and Establishment Act to get your full and final settlement done. Otherwise, file a civil suit against the employer for a mandatory injunction to get the necessary relief along with interim relief.
