Can a Company Terminate You After Sending a Job Offer Letter? Let's Discuss Your Rights

afaque.s7
I have received a letter of appointment on 09/06/15, and on 18/07/15, the company told me, "You are rejected from your job." Can they terminate me?

Assuming that the company revoked your job offer on 18.6.2015 instead of dated 18.7.2015, which is a clerical error, you can sue the company for damages. This is because, under section 5 of the Contract Act, the offer cannot be withdrawn after it has been accepted.

Thanks,

If you have not completed the probation period, the company can terminate you at any time without prior notice.

Clarification Needed on Termination During Probation

The query lacks important information. Is the person on probation? When did he join the company? (He got the appointment letter on 09/06/15). He cannot be terminated by a future-dated letter (a clerical error, I suppose; anyway, it shows a casual and thoughtless approach by the Company HR). If the poster wants clear advice from members, kindly provide additional and relevant details.

Termination During Probation

Termination during probation also has to be done with care. You just cannot terminate a probationer with a stigma. (A due enquiry would be needed.) If termination during probation is based on unsatisfactory service, it can be done, but the employee can challenge it as arbitrary. A probationer is basically on a test, and if he fails the test, the employer can, in accordance with the letter of appointment, terminate him.

Dear,

As per your appointment letter, are you currently on probation? If you are on probation, the company reserves the right to terminate your services without prior notification. Therefore, please confirm whether you are still in the probation period.

Thank you.
