Confused About Resignation Dates? Need Help Understanding Next Steps

Hi all seniors,

Please let me know about the resignation process if I send a resignation letter on 29/06/2015 with these words:

"I am formally notifying you that I'll be tendering my resignation from our company. My last day will be on 28/05/2015."

What are the next steps from the company's side? Please share your knowledge as your reply is important to me.

First, I could not understand how you can say the last day will be 28/05/2015 when we are in the month of June 2015. Please refer to your company appointment letter and follow the clauses for resignation. A formal resignation, giving dates as per the appointment letter, needs to be initiated.

The company will take necessary action for clearing you by retrieving all company property, files, etc. The accounts department will calculate any dues and make arrangements for payment. Your immediate manager will need to assign your duties to another person. The HR department will consider hiring a replacement and providing your certificates according to their policy.

Sorry, I made a mistake. I sent my resignation on 29/05/2015 and included the following line in my resignation letter: "I am formally notifying you that I'll be tendering my resignation from our company. My last day will be on 28/05/2015." My appointment letter states a two-month notice period. The next day, the company sent an acceptance letter. The day after, they sent a claim letter requesting two months' salary as a penalty. My question is, was it right for the company to take this action? If it was incorrect, please suggest what I should do in this situation.

Please read your appointment letter carefully. Does it mention the notice period? How many days of notice period does it specify? You will be legally bound by the terms and conditions outlined in the appointment letter, which you agreed to when you joined the job.

" my resignation are accept next day .and my appointment latter has two months notice period . after accepted my resignation next day they send a latter for penalty of two months salary is this right action taken by company if this is wrong so please suggest me what i do inn this condition

On the lighter side, this appears to be an extension of SMS culture. The date from which the resignation is applicable needs to be given. There cannot be too many shortcuts in life. But the basic principle of what you say is right - the importance of an earlier clean record.

Like Nathrao mentioned, frankly, your SMS culture put you into a situation that could have been very easily and clearly avoided. If you ask me for a very honest opinion, had I been the HR of your company and assuming whatever you mentioned is the full story, I surely would have played football with you had I wanted to... why? You made two mistakes in your letter/mail [which I only hope were inadvertent and not being over-smart to cover up something adverse]:

1) The wordings you used ["...I'll be tendering..."] do not convey that you are resigning... only convey that you intend to resign.

2) You mailed the resignation on 29/5/2015 with the last day being ante-dated (28/5/2015). I am not sure about your reasons for this, but common sense would dictate that the last date would be at least the day of submitting the resignation—unless there's a very strong reason for giving the last day ante-dated [nothing to do with straightforward and transparent motives but everything to do with some sort of cover-up ideas, mind you—hope you get the point]. The fact that the company sent a claim letter of two months' salary as a penalty only gives a feeling that you have not given all the facts.

Clarifying Resignation Communication

The language is unclear and causing confusion. On a future date, you will resign; however, that does not mean that this communication is a resignation. You will need to submit a formal resignation once again. Why???

Simple Resignation Communication

For a clear and simple communication of resignation in plain language, you can write: "I hereby tender my resignation from the employment of the company and request you to relieve me on [specific last working day]. I would like to express my gratitude for the opportunities provided. Additionally, I kindly request to settle my accounts and provide me with an acceptance letter and a service certificate."

Please ensure to include a single line break between paragraphs for better readability.

"I am formally notifying you that I'll be tendering my resignation from .......... Raipur. My last day will be on 28/05/2015. Reasons for resignation: 1 2 3. If there is anything that I can do to make this transition easier for the company, let me know and I'd be more than willing to help out. I have truly enjoyed my work here and I would like to thank you for the opportunity that you have given me to work here at ,,,,,,,,,, Raipur."

First point, Tajsateesh sir, you wrote: "The wordings you used [‘I'll be tendering...’] do not convey that you are resigning; they only convey that you intend to resign." I think that line clearly conveys that I will be resigning. Then, in the second line, I also have confusion, but I wrote this line: "My last day will be on 28/05/2015." I found the meaning of this line at the time of writing my resignation that my last day would be after 28/06/2015 because I worked in the company on 28/06/2015. Please read my condition carefully and tell me any positive points from my side.
