Can an Employee Sue for Unpaid Salary After Resigning Due to Moonlighting?

My company deals in real estate. We hired an employee 1.5 months ago. The employee is running their own real estate company alongside their job, but they hid this information from the company. Upon discovering this, we asked the employee to resign, and they did so voluntarily. However, the company has not provided the employee with their salary for 45 days.

My question is: Can the employee file a case against us, and what is the procedure for termination in such a case, including the salary payout?

Withholding pay of the employee will not be legally correct.

Did you ask him about any business interests he was having during the interview or during joining processes? He will say his wife was running the company or family members were running the business.

If he files suit against withholding of pay, then your company may have to pay.

Pay off the dues to the employee and close the matter.
