Understanding Overtime Pay: Are All Industries Required to Compensate Extra Hours?

Dear All,

I had a doubt about OT work...

1) If an employee works overtime more than the normal time, is it payable?

2) Is OT applicable to all industries?

3) If an employee works overtime to complete his tasks according to his set targets, is it also payable?

The Factories Act of 1948 Regulations

Under Section 59, it is mentioned that if a worker works in a factory for more than 9 hours in any day or for more than 48 hours in any week, he/she shall be entitled to receive wages at a rate of twice his/her ordinary rate of wages for overtime work.

The Minimum Wages Act of 1948

According to Section 33, overtime wages are to be paid at twice the ordinary rates of wages of the worker. It specifies that the employer can require actual work on any day for up to 9 hours in a 12-hour shift. However, the employer must pay double the rates for any hour or part of an hour of actual work exceeding nine hours or for more than 48 hours in any week.

Section 14 of the Act states that if a worker's minimum rate of wages is fixed for a specific period, such as per hour, per day, or any other period, working beyond the set hours is considered overtime. If the number of hours constituting a normal working day exceeds the given limit, the employer is obligated to pay the worker for each hour worked in excess at the overtime rate.

My doubt generally is: The employee belongs to the Financial Sector (NBFC) which is under the Shops & Establishment Act. Working hours are 9 hours. Beyond the scheduled working hours, is it considered overtime and payable? Please provide clarification regarding this matter.
