Facing a Possible Chargesheet: Should My Friend Resign from Her Government Job?

piyush.324
Dear Sir,

My friend is working in a government department, but there may be a chance of a chargesheet against him. So, she wants to resign and join another job. Is this the right decision or wrong for her future?

Thank you.

If a charge sheet is pending, resignation may not be accepted. Another important aspect is that resigning at the time when the charge sheet is pending may prove to be a kind of acceptance of charges. This can be a potential problem in the future. Ask your friend to clear his/her name and then quit if needed.

It depends on the nature of the charges being leveled against the employee and the discretion of the disciplinary authority whether to accept the resignation at this stage. For example, in cases of late coming or unauthorized absence where no moral turpitude is involved, the resignation may be accepted.

Thanks,
Sushil

Dear Mr. Sushil,

I am aware, that is why I used the words "may not be accepted" and not "will not be accepted." But during the pendency of disciplinary proceedings, quitting will always be under a cloud, even if DA accepts the resignation. DA may accept the resignation sometimes when they know the person is guilty, but adequate evidence may not be forthcoming in an inquiry. Here, in this case, it has not yet become a charge sheet.

Dear Mr. Nathrao,

If she resigns and her resignation is accepted, and a relieving letter is issued, then in the future, the company can issue a charge sheet against her.
