How Can I Claim My Unpaid Salary and Benefits After Resigning? Seeking Advice

SAHAD ALI SHAIKH
I was working at C. Doctor & Co. Pvt Ltd, 34 Ganesh Chandra Avenue, 6th Floor, Bagati House, Kolkata-700013. Phone: [Phone Number Removed For Privacy Reasons], [Phone Number Removed For Privacy Reasons]. Director (M) [Phone Number Removed For Privacy Reasons], Ph. [Phone Number Removed For Privacy Reasons]. I was working there since 01.09.1992 as a Fitter and resigned on the 4th of September 2014. (Copy attached) As per the contract, one month notice (which is mentioned in my appointment letter attached herewith), I have worked one month after submitting my resignation at your office. During this period, I met/informed them verbally. I sent many emails to HR and the Director, but they neither deputed any of their representatives to take over my responsibilities/documents nor advised me on any alternative to exit the company's activities. Now, they have stopped my salary, gratuity, bonus, leave, and all other amounts owed to me. I request your advice on how to claim all my dues.

Hi Sahad,

Kindly hire an advocate immediately and send them a legal notice for Gratuity and Bonus. File a complaint with your regional Labour Commissioner. You can also claim the amount with interest for the delay period.

As advised, you can send a legal notice to the company and claim your dues. Was there any response when you asked for the dues?
