Struggling to Get My Gratuity Released: What Can I Do When My Employer Ignores Me?

I left my previous organization on 4th Oct 2013 (DOJ - 06 Feb 2004). After a month, I requested the release of my gratuity payment as I was getting married. Since then, I have been waiting for my payment to be released. I am continuously following up with the accounts team. Sometimes they say no funds are available, and other times they ask me to seek permission from others (and they don't answer). I have already filled Form I and submitted it to the HR department, copied to the reporting manager after one month in Nov 2013.

Please suggest what I can do now as they are not even replying to my phone calls and emails?

Gratuity is supposed to be paid within 30 days of the claim becoming due. Delayed payments are to be with simple interest at the rate of 10%. You can complain with full details to the Labour officer about the delay and silence from your employer.

You can submit the application through the Labour Officer using Form N. The form is attached.
