Can I Claim My Gratuity After Resigning with 4 Years of Service? Seeking Guidance

Hello,

In my last increment letter, the gratuity amount of Rs. 15,000 per annum is mentioned as a part of my CTC. I worked for 4 years and resigned due to some reason. Can I claim this gratuity amount? Management has denied to pay. Please help and guide.

However, in the case you have projected gratuity, it is not eligible for you after 4 years of service.

Is gratuity part of CTC? To the best of my knowledge, it is not part of the CTC. If it is, please let me know under which Act of Labour Law?

Absolutely anything can be put in the CTC. It's not a concept accepted in any labor law. So, nothing compels anyone from putting or refraining from putting any particular item.
