Struggling to Get Paid: How Can I Recover My Salary from My Employer?

I have joined a Noida-based company on 09th Feb 2015 as Deputy Manager - Finance. The salary offered is Rs. 38,000 per month. However, the salary is not paid on time. I resigned on 5th Apr 2015, serving a 15-day notice period (as per the appointment letter) and handed over my assignments to the Director. Nevertheless, I have not received any salary for February 15 and March 15. Therefore, I am requesting your assistance in recovering my salary. How can I recover my salary from the employer? I have sent several SMS to the Director for payment, but the replies have not been satisfactory.

1. **What kind of company is this?** Is it a proprietor-based firm or a partnership firm? What's the employee strength and company size in terms of turnover and EBIT? (Since you are a finance person, you would be able to know it.)

2. **Do you have an appointment letter duly signed by the company official on the company's letterhead?** Does it have any section stating anything about the salary payment (mode of payment, income tax, date of payment, etc.)?

3. **What is the company's history regarding salary payment to employees?** (For the last 6 months or more.)

4. **Is your company registered under the Shops and Establishment Act?** (If yes, then you would be able to see the registration certificate hung at the reception.)

5. **What is the reason that the employer/company has given for not having paid the employees their salaries?**

Send a written complaint to Inspector under the Shops and establishment Act to get your full and final settlement done.Alternatively send legal notice for payment of dues through civil çourt and filing of criminal case of cheating under section 420 IPC since no salary appears to have been made since the beginning.
