Is the ESIC Act Applicable to Our 45-Employee Service Business in Maharashtra?

Dear Sir,

Please let me know the applicability of the ESIC Act in Maharashtra. We are in the service industry. Currently, a total of 45 employees are working.

Dear Sir,

As per the Employees' State Insurance Corporation (ESIC) Act, if more than 20 workers are working in an establishment, they are covered under ESIC.

1. Sir, registration under the ESI Act, 1948, and the rules/regulations framed thereunder is called a Code Number, and you can obtain the same through the online process as well.

2. However, in order to know about the coverage of the areas where your establishment is situated, please contact the nearest office of ESIC.

Merely because your strength is 45, you may not be covered. Please note, your establishment will be under coverage when there is a notification in respect of your establishment. In such notification, ESI authorities give land's Khasra number, exact location, etc., about the industries. Please collect correct details from ESI, verify within your company records related to land, etc., and then act.

If you are working in an ESI-covered area and employees receive wages/salaries of more than Rs. 15,000 per month, then you are covered under the ESI Act.
