Stuck in Probation: How Can I Resign When My Company Ignores My Notice?

Dear Sir, I recently joined a new commercial vehicles firm. I was on my probation period for 6 months. In my offer letter, it is clearly written that if I leave during my probation period, it is at my discretion to complete the notice period or pay for it. I am prepared to pay for my notice period, but the current company is not willing to accept my resignation. Additionally, I have sent them 10-15 emails requesting relieving, but they have not responded to my emails. I also intend to join a new firm in the next 3-4 days. Please guide me on the right steps to resolve this situation.

How many days have you worked in this company? How much notice was specified by your employer?

Please provide a written communication duly signed, confirming that you are leaving the job as per the offer letter. Kindly take this by hand and ensure it is acknowledged. The date of leaving will be ----.

I hereby hand over all company property, including the laptop, etc. Kindly acknowledge receipt.

I am prepared to pay Rs------ in accordance with the offer letter (basic salary + dearness allowance only, not gross pay).

You can leave even if the company refuses relief; no one can compel you to work there if you do not wish to.

Actually, by hand, they are not giving anything. I have worked here for 2 months. It is clearly written in my notice period that I can leave without giving any reason for my leaving. I have sent 10-12 emails for my relieving, even to the VP of HR, but I am not getting any reply for the same. They are just trying to hold me in the notice period, but I don't want to. Is there a way out of it?

You have sent them 15 emails informing them that you are resigning. Presume that you are within the notice period. Please send a letter immediately, giving reference to all 15 previous correspondences in this regard, and state that you regret their poor response. Clearly state that you will not be reporting for work as of a specific date and that you will not hold yourself responsible if you are not relieved from your responsibilities by that time. Send this letter by Registered Post, copied to the Managing Director. That would be beneficial!
