Can My Job Be Terminated Without Notice After Contract Ends? Seeking Urgent Advice

Dear All,

I am an employee in a government autonomous college. Is there any law in labor law that allows the termination of my service without any notice? I have been working in this Institute for 2 years now. However, during these two years, there has been no salary increment provided by the Institute. They have directly terminated my service just 8 days after my contract ended.

I think you are a fixed-term contract employee, and as such, on the expiry of the contract period, your services have been terminated. So, the question of increment is to be answered strictly as per the terms of your contract only.

In this institute, a total of 40 contractual employees are working on a contract basis. Every year, there is an increment of 10 to 15% on their consolidated salary. I have one more question: Is there any rule under labor law that would entitle me to receive a permanent order in this institute because I have completed 730 consecutive working days here?

Dear Sachin,

You have not mentioned the category of your job in the college. Moreover, since it is a government college, both the teaching faculty and non-teaching staff employed there would be governed only by the rules applicable to government servants in respect of recruitment, appointment, regularization, etc.

As such, I am of the view that you cannot seek any remedy under the Labor Laws. However, you can make a representation to the Director of Collegiate Education regarding your grievances.
