Balancing Policy and Compassion: Should We Deduct Salary for Extended Sick Leave?

Hi, I am working as an HR in an IT company. Recently, one of my employees took 7 days of leave in the month of March as she was suffering from Typhoid. According to our company policy, we only allow one leave per month. Please let me know if we should deduct the salary for the 7 days or what actions should be taken to ensure the employee is not dissatisfied.

Hi,

You mentioned one leave. Does this refer to one day off per month or one type of leave per month? Your company can establish any policy, but it's crucial to ensure that these policies align with your state's Shops and Establishment Act and ESIC Act. An employee can take leave for which they are eligible, using any available earned leave first.

Salary deduction should only be considered as a last resort when there are no accumulated leaves or unauthorized absences. In this case, the employee was absent due to typhoid and provided medical records.

Kindly ensure that the correct procedures are followed in such situations to maintain fairness and compliance with regulations.
