Understanding the Employee Compensation Act: Are All Establishments and Managers Covered?

hrandlabourlaws
I have a few queries on the Employee Compensation Act. Please help in clarifying it:

1) Which kinds of establishments are covered under the Act? Are establishments covered by the shop and establishment also applicable under this Act?

2) Which employees are eligible under this act? Are managers eligible under this act? Which section or rule?

Employees' Compensation Act is the provision to cover an employee under an insurance scheme where ESIC facilities are not available or cannot be extended to employees. It is applicable to the employees of all establishments that are not covered under the ESIC.

The Employees' Compensation Act does not have any direct relevance to shops and establishments.

Employees working in shops and establishments are covered and entitled to compensation under the Employees' Compensation Act. Any employee, including a manager, can seek compensation. If the ESI Act is applicable, then one has to seek benefits under ESI, and they are not entitled to claim under the Compensation Act.
