Gratuity Payable - Gratiuty Act

Hi All,
I am working in a company which satisfies the eligibility criteria of Gratuity Act, 1972.
But, the company has not enrolled itself ever under this act with the controlling authority. Now, we have one employee who has completed 5 years of continuous service with the company and upon his resignation, he has asked for the gratuity amount.
No gratuity forms have ever been filled up or applied from both the parties. Could you please let me know whether we have to pay him the gratuity amount or not.

Dear All
Whether the employee worked central/ state government after retirement he is working private sector. He is eligible for Gratuity.

Dear Mayank Kumar ji,
You have to pay gratuity. Not enrolled with controlling authority or not filled up the forms / applied for, is not a criteria to refuse the gratuity.
Hope no HR professional will have contradictory view on it.
