Waiting for My Final Paycheck After Resignation: Should I Consider Legal Action?

RINUSARA
Dear Sir/Madam, I was working in a company for about 1 year and 4 months. Recently, I resigned from there. However, I have yet to receive my 3 months' salary. They had informed me that it would be released along with the current employees' salaries, but I have not received mine as of now. I am considering taking legal action. Could you please suggest to me the approximate time it might take if I pursue a case?

Regards,
Rinu

If you are planning to proceed legally, first of all, do you have any written document or letter which states that the salary hasn't been paid to you? Is it mentioned in your appointment letter any clause which states the time for releasing your withheld salary? Kindly check all the documents you have, then only opt for it.

Regards,
RAHUL JAT.
