Navigating Relieving Letter Issue Due to Data Transfer Concerns and IT Policy Implications

I want to know the process if an employee unknowingly sends some data from their company email to their personal email ID. Will HR not provide the relieving letter to the employee? Please reply to me as soon as possible.

As suggested by Runal, this is the wrong forum. Please put your question in the right forum so it will be addressed by the right people. Also, it would be easier for seniors to respond if you provide some more details.

1. Why is the question about the relieving letter? Has the employee resigned, or do you wish to terminate the employee?
2. Can the employee send an email from the company ID to a personal ID? The important point is whether the data was valuable or proprietary information of the company.
3. Do you have any IT policies restricting this type of data transfer? Are there any HR policies regarding the support of this termination?
4. Has there been any communication with the employee about this matter?

Employee Resignation or Termination?

1. Yes, the employee has resigned. Or should we fire the employee?

Data Transfer Concerns

2. The employee can send emails from the company ID to a personal ID. The important point is whether the data was valuable. Yes, it was his own data collected by him through cold calling in the market during his job—not proprietary information of the company.

IT and HR Policy Considerations

3. There may be IT policies restricting this type of data transfer. It is not confirmed if there is any rule like this. If there is no rule, the employee may not receive a relieving letter. Are there any HR policies regarding support for this termination in HR rules?

4. Yes, the IT team has communicated with the employee about the matter.

Employee Awareness

5. Yes, it cannot be done, but the employee was not aware whether he should send any data from his company ID to his personal ID.

This depends on the organization's IT policy in the employment handbook. But under normal circumstances, the organization's confidential information should not be allowed to be transferred or shared.

Also, the employee should be issued a warning letter for using the keyword "Unknowingly."

Keyboard cannot be used unknowingly. The company should look into the matter. Who reported the breach, the employee himself, or was it found by IT checks/audit? Employees will have a tough time convincing the company about unknowingly using keyboards.
