Can I Opt Out of Provident Fund Deductions in My New Job in Gujarat?

I am working in a Partnership Company in Gujarat with around 200 plus employees. My basic salary is Rs. 31,500. Previously, wherever I worked, there was no PF deduction from my salary. The only deduction was Rs. 200 for Professional Tax. Now, in my new job, there is a PF deduction of Rs. 1,800 per month (Rs. 15,000 @ 12%). I do not want my PF to be deducted. Are there any rules by which I can refuse PF deduction? Please guide me.

Provident Fund Contribution Rules as per the Amended PF Act 2014

As per the amended PF Act 2014, effective from 1.9.14, please review the following:

"A person who joined the establishment with a salary beyond Rs. 15,000/- but draws a salary less than Rs. 15,000/- during a particular month for any reason is not required to contribute to the Provident Fund on the reduced salary. The salary at the time of joining the establishment determines whether an employee needs to be a member of the Fund. In this scenario, if a person starts with a salary exceeding Rs. 15,000/-, they are considered an excluded employee and cannot be a Fund member."

"For further clarity, please go through the following:

'There exist two possibilities when an employee joins a covered establishment with a pay exceeding Rs. 15,000/- p.m. after 1st September 2014: (A) before his joining, he was not in employment anywhere, or (B) before his joining, he was in employment. In such cases, two situations may arise, i.e., (B1) he was not a member of the provident fund or (B2) he was a member of the Fund. Again, there could be two types of cases, such as: (B21) he has already withdrawn the full amount of his provident fund accumulations and is not a member of the provident fund or (B22) he is still a member of the provident fund. Provident fund contribution is not required to be made in respect of the employee falling in category (A) or (B1) or (B21). However, the employees in category (B22) shall continue to be members of the provident fund, and statutory PF contributions are required to be made in respect of these employees up to the wage-ceiling of Rs. 15,000/- p.m.'"
