Can we demote any employee based on their designation and salary? Are there any legal issues related to this concerning PF and ESIC?

Legal Considerations for Demotion and Salary Reduction

Reversion to a lower post and consequent reduction in salary or wages are legal issues that may result in an industrial dispute or court case, in view of the provisions contained in the approved Standing Orders of the establishment or as per the principles of natural justice. Therefore, in my opinion, before proceeding with such action, a suitable procedure is required to be followed by the employer or disciplinary authorities.

EPF and ESI Considerations

There are no legal issues involved in respect of EPF and ESI if an employee is reverted to a lower post or if their salary is reduced. However, in the case where the employee is not covered under the above enactments, they are required to be covered if their reduced "wages" are within the coverable limit as laid down under the said enactments.

Designational demotion to an old post, depending upon performance or any other valid reasons duly proved, can be done without any hesitation. However, as far as reductions in remuneration are concerned, it is not allowed under certain labor laws such as the Payment of Wages Act, Employees Provident & Miscellaneous Provisions Act, etc., unless the demotion is legal in the eyes of prevailing law. Nevertheless, any further increase in remuneration can be stopped freely.

Demotion or Reversion Policy

Demotion or reversion can only be applied to a promotee, not to a direct recruit in a higher post. Please refer to the case of Nyadar Singh v Union of India, as decided by the Apex Court, and subsequent rulings.
