Dear Seniors, According to the law, there are many legal rules and regulations that apply after 240 days. Could you please advise me on how to convert 240 days into months? Should it be divided by 26 or 30?

As per the law, 15 days of earned leave (EL) should be granted to an employee, which the employee must accrue by working a minimum of 20 days in a particular month. If you calculate the working days for each month, there are typically 26 working days, except in February when there are 24. Therefore, the calculation would be as follows:

(26 * 11) + 24 (Feb) = 310 / 20 = 15 (EL)

The 240 days referred to are working days in a calendar year. There is no reason to consider monthly apportioning of the 240 days. These are the minimum working days of a whole calendar year.

Relevance of 240 Days

If you see section 79(2) of The Factories Act, 1948, it mentions the relevance of 240 days: 240 days as a fraction of 365 days of the year is two-thirds. The maximum possible working days of a year will be: 365 - 56 = 309 (52 weekly-offs + 4 national holidays). Therefore, 26 (309 / 12 = 25.75) are considered as the maximum working days of a month.

As per my understanding, there should be more than 240 days in a calendar year for availing statutory benefits, and these 240 days should be net working days.
