Can I Claim Gratuity After 11 Years at a Polytechnic? Seeking Guidance on the Process

I worked in a private polytechnic college for 11 years continuously without any break. I was relieved by the management, mentioning "relieved due to administrative reasons" in the relieving letter on a college letter pad. Is it possible to claim the gratuity for the 11 years? If possible, could you please explain the process to claim the gratuity? I have already received the PF amount.

You can apply through Form I or by a simple application wherein you mention your Date of Joining (DOJ) and Date of Leaving (DOL).

For the second query, if the employer rejects the gratuity claim, you can approach the Controlling Authority of that area, i.e., the Labour Commissioner's office, for the same.

You send a notice from the Assistant Labour Commissioner's office through an advocate. Then you will receive it. The Assistant Labour Commissioner (ALC) is the controlling authority for gratuity.

Claiming Gratuity from the College

It is advisable to claim gratuity from the college. If they do not reply within 30 days, make an application to the Labour Commissioner of your area. He is the authority.
