Facing Absconding Threat for Resignation: How Can I Secure My Experience Papers?

kiranmgks
I was working at Minacs BPO for about 1 year and 2 months. Upon securing a new job, I informed them that I would not be able to continue and requested the immediate acceptance of my resignation. However, the company's HR department stated that they would deduct my basic salary and provide the necessary paperwork. When I went to collect the documents, they informed me that I must serve my notice period, or else they would mark me as absconding right in front of me. I had worked for 14 months, and obtaining the experience and relieving papers is crucial for me. I am not seeking any monetary compensation, only the necessary documents. Please assist me.

Thank you.

Please offer to buy out the notice period. If you cannot afford that, write to your HR requesting your release on humanitarian grounds. If you share the draft, we can help you with our suggestions if required.

Humanitarian Grounds for Leaving Without Notice

What humanitarian grounds are there when a person wants to leave without serving notice because they have another job? These are the same people who would be crying and complaining if the company had terminated them without notice and asking how to "go legal".

If you need immediate relief, the only consequence is losing a portion of your basis for the notice period, nothing more, regardless of nationality.

Notice Period and Its Importance

The notice period is not mandatory but is based on goodwill. The organization needs time to plan and transition your work to the next person technically, ensuring no disruption to the business upon your resignation.

Assessing Inability to Serve Notice Period

Inability to serve the notice period is assessed based on your relationships, dependencies, and medical emergencies.

Respecting Commitments

When you respect your commitments and they reciprocate, issues like absconding or threats do not arise. Absconding is a significant term to address from your HR perspective.

Notice Period: Is It Mandatory?

Notice period is not mandatory? You mean that anyone can leave without giving notice? That's news to me.
