Struggling to Get My Final Settlement: What Steps Can I Take to Claim My Dues?

Hemant Kulkarni
My previous company told me to resign and relieved me on the same day. They have not cleared my full and final settlement for more than 9 months. There were 64 balance leaves. They are hesitating to pay one month's basic salary for the notice period and the amount for 64 leaves. I am in another state, far away. I am following up via telephone as well as emails, but there is no response. My dues are more than 1.25 lakhs.

Next Course of Action

What should be my next course of action? How can I proceed? Is it mandatory by law that the company has to pay me the dues for 64 leaves as well as one month's basic salary? In my appointment letter, the clause for one month's basic salary is mentioned. Please guide me.

Since you worked in Surat, you are governed by the Bombay Shops and Establishment Act. Make a complaint to the inspector under the Act for non-payment of dues. Enclose all correspondences made by you with the employer.

Thanks,
Sushil
