Termination After Resignation - Hr Head

Hello seniors ,
I am working in Big construction company,posted at a real estate site in noida
I sent the resignation to my boss on 4th feb 2015 thru mail & marked copy to HR & requested to relieve me by 28th feb 2015.
On 12th feb ,when i contected to HR for acceptance/status they told me that they dont have any information , also they issued termination letter to me. when i go to HR head ,he told me that they do not accept resignation thru email.
Than i came to my boss & take his recomndation/sign on print out of email & again went to the HR
Now he had given me 2 options-
1 ) if you want acceptance of resignation, w'll relieve you from 2nd feb 2015 & your notice period of 30 days will be waived-off.
or
2) accept the termination letter & serve the one month notice till 13th march 2015.
i requested to HR again & again to accept the resignation & i'll serve notice period till 13th march but he is not agree.
I am coming to office daily basis as on today.
I am confused now feeling totally helpless.
Pls advice, what should i do.

Always submit your resignation in ink. what's the issue in re-submitting the resignation letter in hard copy and serve the notice period for one Month, as per the policy in vogue?

If your HR Head is adamant then please go with option No. 1, they will relieve you immediately without notice period, at the max you will lose 26 days pay instead of Termination Letter, Legally they cannot terminate you without domestic enquiry. But it is not wise to fight for it and spend your time, money and energy. Please try to negotiate a way out

The company has option of accepting your resignation with immediate effect any way. But why are they insisting on termination. There are some facts you have not disclosed to us

submission of resignation personally is always better and resignation on email can only be considered in exceptional circumstances. since you are attending the office,there is no point of resignation on email.therefore submit your resignation properly and get better exit by getting your FF and service certificate.

Hello Amit,
The options given to you by the HR head DO LOOK curious........I tend to agree with what Saswat Banerjee mentioned ["There are some facts you have not disclosed to us"]. Usually it's the OTHER WAY ROUND--Termination without any Notice Period OR Resignation with Notice Period.
Coming to 'how to handle' the situation, like Saji suggested, just go ahead with Option-1, with the associated downside of 'not getting salary between 2 Feb to date', etc.
HOWEVER, pl ensure you get CLEAR OK that you will get your Relieving & Experience Letters without any issues--ideally insist on taking it by-hand BEFORE you come-out. Don't agree for 'take it after 2/3/4/5 days' sort of situation. In all probability you won't get it then--or @ best, after many hassles & running around.
