Seeking Help: How Can We Claim My Late Brother's PF and Pension Without HR Support?

My brother was working with a company in Gandhidham and left the company a few years ago. Now, he is no longer with us. We are now seeking to claim his PF amount along with the pension scheme, and we have already submitted all the necessary forms and certificates. However, the HR of the company has refused to take action and submit the forms to the PF office in Rajkot. While the money is not our primary concern, we are more focused on the properties left behind by my brother, which are of utmost importance to us.

Alternative Ways to Receive Pension or Amount

If there are alternative ways to receive the pension or the amount, please provide detailed information about them. I kindly ask for your assistance in this matter and guidance on the best course of action to secure the pension, as it serves as a reminder of my brother for us.

PF, Pension, and EDLI Claims

Not only are PF and pension eligible, but EDLI is also eligible. Normally, all these claims are processed immediately after death. Why is it delayed in this case? It would be better if you contact the concerned Regional PF Commissioner's office regarding this.

Pension Distribution and Required Documentation

The pension will be received by his two children and wife. Therefore, the required documents need to be obtained from the Tahsildar office, including a translation into English by an advocate, and the death certificate. 100% of the benefits will be received by them.

In the last two months, I was busy with work and had to pressure the company's HR department to send the claim to the PF office. Now, the PF staff (AO) has informed me that I am not eligible for a pension. The PF office provided me with reasons such as:

1. The requirement to continue working with the same PF number for a minimum of 10 years.
2. Initially, the PF pension is given to the dependent father. A dependent father is one who does not have a job or earns a maximum salary of 3,000.
3. If the father is deceased, the PF pension is then given to the mother.

I would like to share some details with you and hear your thoughts on whether this information is correct or not.

The details are as follows:

1. I worked in the company for 2.5 years.
2. The death occurred after leaving the job.
3. My father is currently employed at the Bank of India and has two more years until retirement.
4. My father's salary is more than 50,000.

The PF office mentioned that my father could not prove dependency on me; therefore, I am not eligible for the pension. However, I can withdraw all other amounts.

I seek confirmation regarding the reasons provided by the PF office as I suspect corruption among the staff who may be accepting money from companies. This situation has left me feeling confused.

I regret to inform you that your brother passed away before reaching the age of 58 years. In such circumstances, completing 10 years of service is not necessary to be eligible for a pension. Additionally, your father's income will not affect his eligibility to receive pension benefits, as the PF pension serves as compensation for the member's contributions to the Employee Pension Scheme (EPS).

Your father may be entitled to a pension amount of Rs. 2051.
