Navigating ESIC Registration: How Can Our Consultancy Get Started or Obtain a Non-Applicability Certificate?

Dear All,

We are an engineering consultancy. Currently, we have two full-time employees and five employees on a consultancy basis (all earning more than Rs. 25,000). Kindly advise me on how to get registered with ESIC.

In case we are not applicable or eligible for ESIC, can I obtain a certificate stating that we are registered but not applicable?

ESIC Applicability Criteria

The ESIC is applicable to employees drawing compensation below Rs. 15,000 per month. Also, the strength of your consultancy is only 7. As per the Act, the Employee State Insurance Corporation is applicable to companies that have more than 20 employees. You don't fulfill both criteria.

Coverage Under the ESI Act, 1948

1. Coverage under the ESI Act, 1948, and the rules/regulations framed thereunder is not optional.

2. However, the ESI Act is applicable in those factories situated in implemented areas as notified under section 1(3) where 10 or more persons are employed. The term "person" is very broad and includes all persons employed, including casual, temporary, and contract-based workers.

3. Some State Governments have also extended the provisions of the said Act under section 1(5) to some establishments employing 10 or more persons.
