Can a Company Send a Notice Without Issuing an Offer Letter? Seeking Advice on My Situation

Hi seniors, I really need your help. I have not received any appointment letter, offer letter, or confirmation letter from the company. After working for 3 months, I informed them that I won't be coming to the office. Now, they are saying they will send some notice to my place. Can they do this without issuing an offer or appointment letter? It's a CA firm.

No, they can't. There's nothing they can do. However, even if they send you anything on the company letterhead, don't panic as they won't dare to go any further. In your case, all the rules have been overlooked. The company would be at a loss of face if they attempt to send you a notice.

No terms and conditions were agreed to, and no appointment letter was issued. You can contend it was an ad hoc arrangement. The company ought to have issued an appointment letter as per the Shops and Establishment Act provisions. If you had been a workman, the case would have been different.

In continuation of the above, it may be noted that the Shops and Establishments Act does not apply to the CA firm in which you were engaged. Despite that, under the Contract Act, the terms and conditions were not concretized. See SBI vs Rakesh Tiwari.

Hi, they have considered me as a professional, and they were taking my signature on a cash voucher after receiving my salary every month (I have completed my articles there only). So, there won't be any problem?
