Left a Job 2 Years Ago: How Can I Withdraw My PF Without Paying the Company?

Hi, I left an organization 2 years back, and they say that I am liable to pay them Rs. 5000 approximately. However, I don't wish to pay that amount as I do not find it feasible. The company has not yet given my F&F, and I wish to withdraw my P.F amount.

Please suggest if there is a way out where I'm not supposed to pay that amount to the company and get my P.F. In this situation, how many days will it take to get the P.F?

Hey,

Thanks for replying. The company says that as I did not serve the notice period is why I am liable to pay them Rs. 5000. They also state that I need to first pay them a cheque of this amount, and after the clearance of this is when they shall process the P.F.

There have been a few friends who suggested going to the P.F office, filling a general P.F form, and providing a government bank account number, and my P.F will be transferred. I would like to confirm if this is one of the options and does it really work without getting the employer involved?

Hey,

No one can take your PF amount at any cost. You are eligible to your PF amount even if you have not given your notice period.

The Form 10C and 19 need to be submitted by you to the PF office. They have to go to the employer for filling in the details of every month-wise deduction. The employer holds the key in this process. However, they cannot delay for more than 15 days.

The employer might provide incorrect details and cause delays in the withdrawal process. They may even claim that since you have not fulfilled the terms and conditions, it would be advantageous for them.

Nevertheless, the employer cannot prevent you from making a withdrawal. You must submit a letter to the PF commissioner explaining that due to personal reasons, you were unable to complete your service and now require the money.

This should suffice. Remember to attach a signed cancelled cheque along with the form so that the amount can be transferred to that account.

I need some clarification. I am planning to resign from my current organization, and I want to withdraw my PF. I have more than 20 months of work experience in this organization. Will the PF office deduct any amount, and am I eligible for withdrawal?

Dear friend,

Your company's view is right if there is a clause in your appointment order/contract signed by you at the time of joining with the company regarding the NOTICE PERIOD. The company cannot ask you to forward the PF claim for this reason, but they can withhold your service certificate and relieving order issuance. Since it may impact your future service, it is advisable to settle the amount and obtain the relieving order and certificate if there is any clause as mentioned above.

You can transfer the PF accumulations by submitting Form 13 to your current employer.

If you wish to withdraw your PF accumulations without involving your previous employer, follow these steps:
Step 1: Download the withdrawal forms in Form 19 and 10C, NSSN FORM from the EPFO website.
Step 2: Fill in all your details and provide your savings bank account information in the bank account column.
Step 3: Enclose the first page of your Bank account Pass Book.
Step 4: Send the complete set of forms with enclosures to your previous employer for forwarding the forms to the PF office.
Step 5: Obtain attestation in the column of attestation of employer/authorized person from the bank manager where you hold a savings bank account if you intend to send the claim directly to the PF office.
Step 6: Send the set of forms to the PF office where your previous employer has accounts using registered post.

You will receive your money in your bank account within 45 days.

It is generally recommended to settle the withdrawal through your previous employer.

Can you please tell me if an employee starts receiving a basic salary of more than PM, do they still need to have their PF deducted? If it needs to be stopped, what is the procedure?

Withdrawing the PF has become a horrible situation. For a year, I have been chasing my previous employer to get my PF amount, but there has been no update until now. Is there any direct contact with the PF Office where I can check whether my form is in process or not? It's surprising that I don't even know the PF number as it was not shared by my previous employer. In this case, what can I do?

Dear Ms. Gowri,

Once an employee is covered under PF, his salary is to be deducted with PF until his last day of working, even if the salary is raised above 6500. The contribution may be based on his total salary or restricted to Rs. 6500, while the employer contribution is to be limited to 8.33% on 6500 for the Family Pension Scheme and the remaining to EPF.

For newly joining persons with a salary exceeding 6500, you may restrict their contribution to 6500.

As per my knowledge, the form had to be submitted by my previous office on January 17, 2010, and within 45 days, I should have received my PF. However, to this date, I haven't received it. I have received vague answers when checking with my previous employer. Being with the company, I am aware that they did everything possible to delay an employee from receiving their Provident Fund. Not a single employee has received the PF easily, so I believe it's now my turn. I decided to check with the PF Office in Mumbai and was informed that the form had not been submitted as of May 31, 2010. When I confronted my previous employer, they mentioned that the canceled cheques were not submitted, so the form was not processed. They had not even informed me about this requirement. Is there any action I can take for this unacceptable delay on purpose?

I have sent the cheques today, June 1. Can someone please advise me on this? I really want to address this issue because it has been years, and this company has been causing trouble for their employees in this manner.
