Gratuity Dilemma: Should We Pay an Employee Serving Notice After 5 Years?

In our organization, we came across a case: We have an employee who completed 5 years within the organization on 26th December 2014, but he had already resigned on 1st November 2014. His last working day is 13th January 2015.

I am confused about whether we need to pay gratuity to this employee or not, as he is currently serving his notice period.

Service is the duration between the joining date and the relieving date (last working day). Hence, the date of application for resignation is immaterial.
