Employment Injury and Leave Policies
Obviously, in the case of employment injury, i.e., an accident occurring on duty, the employer is bound to give leave with salary until the employee is fully recovered. This is provided in the Employees' Compensation Act. In respect of those covered under ESI, naturally, the task of paying leave salary, etc., is taken care of by the ESI Corporation.
In order to cover those not under ESI, you need not have a separate leave policy because if you frame a policy, it should specifically state the number of days' leave an employee will be entitled to have in case of an accident during the course of employment, and that cannot be predicted and will depend upon the nature of the injury. It is always good if you leave it as such, stating that as per the law in force.
