Employment Injuries and ESIC Procedures
1. Accidents can happen anytime and anywhere. However, to be treated as an employment injury, the accident must occur out of and in the course of employment. An accident can happen even on the first day of employment or within a few days when no contributions under the ESI Act, 1948, have been deducted and paid by the employer.
2. It is essential that the injured employee is on the attendance roll of the employer, their declaration form has been submitted by the employer, and an insurance number has been allotted. Otherwise, it will be difficult to get benefits under the above Act.
3. The injured employee or their family members should contact the employer to ask for the insurance number and ensure that the employer has submitted the accident report to the ESIC Branch Office and the appropriate ESIS dispensary to which the employees of the unit are attached. In such a situation, the injured person can obtain a medical certification from the ESIS dispensary and also benefits from their ESIC Branch Office.
4. I believe that ESIC authorities will not reject the case if the employer has obtained the insurance number of the injured employee and has submitted the accident report. The injured employee or their family members can appeal to the higher ESIC authorities in your area in case there are any grievances.
