One of our employees had suddenly expired due to a heart attack. What are the general formalities one should go about?

Well, this case happened with one of our employees as well. In this situation, it is the management who clears the no dues and forwards letters to PF and Gratuity offices to ensure that the family of the deceased GETS THE SETTLEMENT without any hassles, since your employee died while in service.

IT IS YOUR RESPONSIBILITY / THE HR RESPONSIBILITY TO GET ALL DONE... AND DO IT URGENTLY... WITHOUT DELAY.

This type of case is to be handled immediately in the interest of the deceased's family. I hope you understand that in this case, whatever an employee does for his benefits, the management is now responsible for. GOT IT.

Dear Marvin,

Please confirm the name of the nominee by Form 34 of the Factories Act. Ask them to obtain the death certificate, usually within 5 or 6 days, by paying extra fees. Submit the death relief fund claim form to the ESI Corporation along with the death certificate. Also, submit the death relief fund claim form to the Labour Welfare Board with the death certificate. Submit the EPF and FPF claim forms as well.

Check whether the deceased had paid any premiums to LIC and proceed with the necessary applications. Submit an application to receive the full amount from gratuity. Arrange for the settlement of the full and final amount, including salary, PL encashment, and bonuses.

If possible, gather voluntary donations from both employees and management to provide to the nominee. Lastly, ensure to take care of the deceased's family members.

If the death occurred while in service, many benefits are applicable including pension, PF, gratuity, and possible services provided to the son or the Govt servant as per the applicable clause.

If the death occurred after retirement, the pension is transferred to the wife's name.
