Procedure to Close a Factory Permanently in Tamil Nadu

- Can anyone explain the procedure for closing a factory?
- Are there any forms required under the Factories Act?
- Is there any other procedure involved?

Section 2(cc) defines the term closure under IDA 1947. There is a condition and procedure under Sec 25FFA and under Sec 25-O(1) under Central Rule Rule 76C(1). At the same time, please go through Chapter VA & VB of the Industrial Disputes Act, 1947 for effecting closure of your factory. All the above will provide the condition for closure.

Notices/Forms Required for Closure

Notices/Forms to be filled if closure is under Section 25-FFA of The Industrial Disputes Act, 1947 Rule 76-B, Form Q (Form of notice of closure to be given by an employer) to be sent by the employer to the Labour Secretary (GoI)/RLC(C)/ALC(C)/Local Employment Exchange. If the closure is under Section 25-O(1) (Form of notice of closure to be given by an employer), it should be sent by the employer to the Labour Secretary (GoI) with a copy to the Registered Trade Union of the establishment. Settlement under the closure has to be done by paying the notice period to the employees and all other due clearances like Gratuity, PF, and Bonus.
