Employee Termination for Theft: Can They Still Get PF and Gratuity Benefits?

In our organization, one employee has been found guilty of stealing some merchandise and has been terminated. Will he be able to receive PF and Gratuity benefits?

Clarification on PF and Gratuity Eligibility

In a single-line query, the members cannot provide an appropriate view until it is detailed. An employee can claim PF. Regarding gratuity, it can only be forfeited upon the termination of an employee for moral turpitude, riotous or disorderly behavior, wholly or partially for willfully causing loss, destruction of property, etc. Additionally, if the employee has not completed the qualifying term.

Moral Turpitude and Gratuity Forfeiture

Stealing merchandise amounts to moral turpitude. Since the value of the merchandise is not known and the employer has not initiated legal action as per the query, it would be an assumption to give views before knowing the facts. Hence, I have written the clause of forfeiting gratuity. Please guide us if it is wrong on my part.
