Notification on Bonus Act Annual Return

Enclosed is the notification dated 10th November 2014 regarding the Bonus Act annual return Form D from the year 2014 onward. This has been amended on the following topic for your reference and necessary compliance action.

Highlights of the Amendments:

• **Annual Returns:** Every employer shall, on or before the 1st day of February each year, upload annual returns in Form D on the web portal of the Ministry of Labour and Employment, providing information as to the particulars specified in respect of the preceding year.

• Every employer, on or before the 1st day of February each year, may file annual returns in Form D to the Inspector, giving information as to the particulars specified in respect of the preceding year.

**Explanation:** For the purposes of this sub-rule, the expression "electronic form" shall have the same meaning as assigned to it in clause (r) of section 2 of the Information Technology Act, 2000 (21 of 2000).

Form D and the notification are also attached herewith for your reference.

How to Upload Annual Returns in Form D on the Web Portal

Is the portal opened by the Ministry of Labour? How should the process be followed? Any member who can shed light on this for the benefit of the members, it would be greatly appreciated.

The Ministry of Labour & Employment has opened the "Shram Suvidha - Unified Portal for Labour and Employment" at the following link: http://www.efilelabourreturn.gov.in for online registration of units, reporting of inspections, submission of returns, and redressal of grievances.

This web portal will be operated through a Unique Labour Identification Number (Shram Pehchan Sankhya) for each employer/establishment for the e-filing of all annual returns. The portal is designed for the filing of single harmonized annual returns by the employers.

On that website, there are no options provided to upload returns. Has anyone come across these options? If so, kindly share the procedure to obtain the option/tag.
