Struggling with PF Settlement After Resignation: How Can My Sister Resolve This?

My sister was working in a school, and she resigned in April 2014. Now, she is following up with the school management for her PF settlement, but the school management is not helping her. They are giving various excuses whenever she visits or calls the school management.

Current Situation

Currently, they are using the excuse that the Universal Number Registration Procedure has not yet started. They claim that only after she registers with her UN Number will she be able to settle her PF dues. However, to my knowledge, one can proceed with the PF withdrawal procedure even if the employee is not yet registered with the UN number.

Kindly suggest.

EPF Account Transfer and Withdrawal Process

After resigning from the school, if she has joined a company where EPF is applicable, it is advisable and simple to get the old account transferred to the present one. This transfer can be done online as well. Otherwise, you will have to send the withdrawal forms to the school and have them forwarded to the EPFO. If they are not cooperating, you may file a complaint with the Assistant PF Commissioner of the area. They will take care of the rest.

There is a chance that the school management has not deposited the PF dues, which may be why they are showing reluctance to sign the PF forms. Generation of UAN, etc., has nothing to do with withdrawal. Applications for withdrawal and transfer are also accepted in hard copy forms.

If the school management is not helping, then tell your sister to fill up the PF withdrawal form and submit it at the PF Office. The further process will be done by the PF officer who will sign the documents required by the school.

EPFO Authorized Signatories for PF Forms

The EPFO has authorized certain persons like MPs, MLAs, Gazetted officers, and Bank Managers (of the bank to which the fund amount should be transferred) to sign the PF forms in the absence of the employer or if the employer refuses to sign. It does not mean that you can just submit the form without the signature of any of these authorized signatories. You have to get the forms attested by any one of the above and then submit it for withdrawal. The EPFO will then direct the employer to submit the other forms like 3A, 5, and 10.
