Can My Friend Resign from Her IT Job Without a Joining Letter or Salary?

Sunil Sain
One of my friends is working in an IT company as a Jr. Developer. The problem is that for a couple of months, they have not been paying her salary. One day, when she mentioned that she wanted to leave the company, they transferred her salary. However, she faces this kind of behavior every time, so now she doesn't want to work with this company anymore.

They have also not provided her with a joining letter, but she signed a document at the time of joining which is on a simple paper stating a one-year bond. Additionally, she submitted a Rs. 10,000 DD to this firm.

Resignation Possibility

So, my question is, is she able to resign from this company and how?

Please reply ASAP.

Thank you in advance.

If the appointment letter is not signed, it is not difficult to resign from that company because technically, your friend is not an employee of that company. However, as per the information provided by you, the company does not seem to be a professional one. So, if your friend resigns from that company, they will probably refuse to provide a relieving letter and Rs. 10,000.

I suggest talking to the reporting boss and convincing him to help her get a respected and full separation.

Note: I am assuming that she did not sign the PF or ESIC documents.

She has given a DD or a cheque? If it is a DD, then the money is lost. If it is a cheque, you can give a stop payment order.

Validity of the Bond

The bond is meaningless in a situation where the employer failed to pay salary regularly and on time. There is no reason to even look at the validity of the bond.
