Navigating Short Notice Resignation: Can I Use My Leave to Join a New Job on Time?

Currently, I am working in a State Government PSU and I also have a central government PSU job. As per my company's rules, there is a two-month notice period for resignation. Up to now, I have not served the notice period, and my final joining date at the new company is less than 2 months away.

I have decided to serve a shorter notice period so that I can join the new company within the stipulated time. I kindly request assistance with the following queries:

1. I have 42 ELs remaining to date. Will these be adjusted for the short notice period?
2. Can any leaves be taken during the notice period?
3. If I take leave during the notice period, will it extend my notice period?

You can serve a short notice period provided the company/organization agrees to it. In many cases, the organization asks the employee to deposit an amount equal to two months' salary. Otherwise, what are the rules specified thereof...

Leave Adjustment During Notice Period

In some companies, Earned Leaves (ELs) are adjusted if you do not serve the full notice period. If they are not adjustable, the company may provide leave in cash. You need to consult the HR department of your company for this.

Taking Leave During Notice Period

Yes, you can take leaves while you are in the notice period, but those leaves will not be considered as paid leave, and the notice period is not extended. However, it is recommended not to take leave while serving the notice period unless it's genuine.

Leave Encashment and Notice Period Adjustments

Adding to what I said, leave encashment will be up to a certain limit of leaves as per the company policy. If all these are not done, then they may ask you for deposits for the number of days you are not serving the notice period. Otherwise, it will be deducted from your full and final settlement.
