Resigned for a Job That Got Delayed: How Can I Seek Compensation or File a Complaint?

tarunsakunia
I received an offer letter from a Third Party and was supposed to be deployed at Infosys on 3rd November. I resigned on 31st October. However, on 1st November, the Third Party informed me that the joining date had been postponed. They are unwilling to pay me until a new joining date is provided. Recently, they confirmed that the position is on hold until December and advised me to search for a new job. Since I was on their payroll and never visited the client's site, they refuse to compensate me. I am considering filing a complaint against them. Can you please advise me on where to file the complaint?

Understanding Offer Letter Obligations

If it is mentioned in the offer letter that you should report by 3rd November, it means that you need to report at the client's location without fail. Otherwise, the offer shall become invalid. You can file a case only if you are before November 3rd.

Yes, the joining date was mentioned in the offer letter as 3rd November. However, I received an update from them on 1st November that the date has been postponed, which was a verbal confirmation. Therefore, I did not report to the client.

You could have asked them to send everything in written format on November 1st itself. With that copy of written communication, you could have filed a case on the same day. Alternatively, you should have gone directly to the client's location with the offer letter.

Anyways, whatever happened has happened. Still, you can try filing a case. Please talk to the third-party people very politely and then let them start giving promises; record everything on your cell phone. This could be the only witness for you to proceed further. Then approach the policemen or labor court with the recorded phone conversation as a witness.
