Struggling to Get My Relieving Letter and Provident Fund – What Should I Do?

Hi all, I am an ex-employee of a company. I worked with them for 3 months. In my appointment letter, it's mentioned that I need to serve a 45-day notice or pay notice pay in lieu for 45 days. As per the appointment letter, I need to pay 28,500 rupees, but I discussed with the director and agreed to pay 10,000. So, I took some time to pay, and I paid 10,000 on 2/9/2014. However, I have still not received my relieving letter, and the HR people are not responding to my calls or emails.

Documentation and Relieving Letter Issues

What documentation do you have of the company accepting your short notice? Do you have a receipt or acknowledgment of paying them ₹10,000? You can always explain to your new employer the problem and ask them what documents you can provide in place of the relieving letter.

However, most people will not bother to even include a 3-month job experience on their CV as it may look bad. Will your new company accept the relieving letter from your previous employer?

I do not have any receipt or acknowledgment for the payment. However, I have all the recordings of discussions that occurred between the director and HR. Is it possible to provide me with a relieving letter format mentioning notice pay? I am not going to mention the 3 months' experience in my CV, but as I have already informed my current employer, I need to submit it. My present company is asking for a relieving letter or email from HR regarding notice pay.

Am I eligible to apply for PF because I worked with them for only 3 months?

Understanding Recording and Evidence

First, what is recording? Is it a voice recording or an email? If it is a voice recording, the HR department in the new company will not accept it because they cannot keep it on record. Besides, there are rules against recording conversations without consent. If it is in writing or email, it would be good to share that with the new employer.

However, I still do not understand how you do not have any evidence of having given so much money. I hope it was paid by cheque so you can show the bank statement to your employer. There are various formats of relieving letters available, both on this forum and on Google. You can choose any of them. It would not be a good idea to mention short notice on the relieving letter but to have a clean exit. Future employers are not going to be concerned about whether you paid for the notice period, but only that you were relieved properly.

Provident Fund Transfer

Regarding the PF (Provident Fund), it's better to transfer your PF to the new company. This can be done online and no longer requires approval from the previous employer.
