Guidance Needed for Corporate Office Compliance

Our factory is situated 60 km away from our city, and our corporate office is located in Vadodara city. Our factory is registered under the Factories Act, but for the corporate office, I need to know if there is any act which is applicable as we have 8 employees working there. We are following all the rules and regulations according to the Factory Act.

Kindly guide me on what I should do. Should I have to follow the S&E Act?

Applicability of S&E Act to Corporate Office

To your Corporate Office, the S&E Act is applicable, and you are required to obtain a Registration Certificate under the S&E Act. Any business premises other than a factory under the Factories Act require you to obtain a Registration Certificate under the S&E Act, irrespective of whether you employ any person or not. To obtain the Registration Certificate under the S&E Act, you need to approach the authority under this Act in your locality where such premises are situated. Each such premise will have a separate Registration Certificate. The rules and regulations under the Factories Act do not apply to such premises. You are mistaken in applying the rules and regulations of the Factory Act to your Corporate Office. The rules and regulations under the S&E Act are applicable to your Corporate Office.

Certain areas are exempted from obtaining a Registration Certificate under the S&E Act as per the notifications by your State Government.

Thanks, yeah, I got my answer and I will find out how to get that registration done. I will also try to convince management to follow the S&E Act.

You need to apply for Shop & Establishment Act registration at the nearby labor office. Your office does not fall under the Factory Act.
