Bonus - Enforcement

I would like to know whether it is statutory liability for employer to provide Bonus to Ex-Employee whose Gross Salary was more than Rs. 10,000/- in the last F.Y. 2013-14. Again If the Employer is not providing the same....can I File complaint for the same to Labour Office ???..The employee worked for more than 30 days in the previous F.Y. 2013-14.

As per Sec 12 of Payment of Bonus Act 1965 Employees drawing wages upto Rs.3500 per month or less. For calculation purposes Rs.3500 per month maximum will be taken even if an employee is drawing upto Rs.10000 per month. So in your case your Salary is beyond Rs. 10,000/- per month so you are not eligible as per Act.

It is NOT GROSS SALARY but basic+DA more than RS 10000/-pm that dissentitle an employee for statutory bonus.

However if the above condition is also fulfilled and employer is still not giving the Bonus then what are the measures one can take against the Employer.

You can raise a dispute before the conciliation officer designated by your state Govt.

Dear Friend,
It appears that your salary comprising of basi & da is less than Rs 10,000/ pm. So under the bonus act, you are eligible for bonus. If you wish, you may raise a dispute against the company under the aforesaid act before the labour commissioner falling under your jurisdiction.
