Eligibility for Weekly Off with Part-Time Work

My query is: if an employee works only 2 days a week and is entitled to a weekly off, and the organization observes the third Saturday as a day off, how many days do they need to work to be eligible for the weekly off?

An employee who has worked only 2 days in a week is not entitled to a weekly off. The provision of a weekly off is for those employees who have worked 5-6 days in a week (depending on company policy).

I have already mentioned in my previous post that a weekly off is provided to those who have worked for 5-6 days in a week. Beyond that, it depends on the company policy, how it is formulated, and what rules are defined for leave.

Please refer to your leave policy or go through the leave rules of the respective act applicable to your organization.

The responsibility of the HR manager is twofold: towards the employee as well as the employer. They must strike a balance between the two, taking into consideration production, productivity, and the morale of the workforce.

Granting a largesse by providing a weekly day off to a worker who has worked only 2-3 days in the week may motivate many more workers to make the same request, potentially leaving the management struggling in terms of productivity. The decision, if made as suggested above, could create more problems than it solves. I agree with the views expressed. Please attempt to take a balanced approach to this and other similar issues that may arise in the future.

Would appreciate it if you could elaborate on your query in detail to provide an appropriate view from forum members. Additionally, if an employee has recently joined your company, for example, on Friday and Sunday being the weekly off days, you cannot ask the employee to report to duty since they have only worked for 2 days.

To get a weekly day off with pay, one should work for six days in a week as per the act. However, in the six days of work, if one applies for leave for one or two days, it will still be counted as days worked. This policy depends on the company's own regulations. Some companies consider prefix and suffix attendance for granting a paid weekly day off, while others require at least four days of work in a week to qualify for a paid day off. All of these factors are negotiated through collective bargaining with unions within the company.

To be eligible for a weekly day off with pay, one must work at least four days in a week. If an individual works for only three days and then rejoins on Monday, they are not entitled to a weekly day off.

The Act itself prescribes that employees are entitled to a weekly day of rest only after working for 6 days or 48 hours. If the weekly day of rest is common to all, you can follow the standard procedure. If it varies from department to department, then you must allow it only after 6 days. Nowadays, some companies are operating on a 5-day workweek, which can replace the 6-day requirement.

The law states that an employee who works more than 48 hours should be given a weekly day of rest. You now have the opportunity to design the weekly rest schedule for your employees.

What if there are only 5 working days a week? As per labor law, can we give one weekly off (paid off) if he/she continues to work for 5 days without any leave? Please suggest.
